XL Group endorsement designed to protect contractors from underinsured subcontractors who cause pollution

XL Group plc announced last week its North American environmental business is adding an endorsement for subcontractor excess and difference in conditions to its existing contractor’s pollution legal liability policies.

The Dublin-based firm stated June 27 the new endorsement “adds protection for the insured against uninsured and underinsured subcontractors whose work results in a pollution condition on a job site but may not have any or enough environmental insurance to meet their clean up obligations.”

SpillThe endorsement is intended for general contractors, trade contractors, as well as environmental contractors and consultants, XL Group stated in a press release. The policies are written by two of XL Group’s carriers, Indian Harbor Insurance Company and Greenwich Insurance Company. Indian Harbor is a U.S. based non-admitted excess and surplus lines carrier while Greenwich is a U.S. based admitted insurer.

Last week’s announcement came two weeks after XL Group announced pollution coverage in North America for airports. That would include disaster response expenses, contractors pollution legal liability and remediation expenses, among others.

Last April, XL had announced a new policy that would cover environmental liability and cleanup for food and beverage manufacturers in the U.S. and Canada. That policy is intended to cover accidents such as ammonia discharges, pathogen contamination and faulty wastewater treatment.
